Elimination of PC 290 Registration as Sex Offender

Those opposed to termination of a PC 290 registration cannot use the crime alone to establish " a current danger" in Santa Rosa, Lakeport and Ukiah

Previously, PC 290 made someone register for life with no exceptions. That has now changed. PC 290 lawyers recognize that the new laws as of 1/1/21 made three new tiers or groups for consideration of elimination of registration.

The District Attorney can fight the request to terminate PC 290 registration by claiming that community safety would be significantly enhanced by continued registration.In a recent case, the DA and the court relied primarily on the nature of the conviction (which involved a 12 year old girl) to establish the threat to the community's safety. As the best PC 290 attorneys would do, the case was appealed and the Court of Appeal agreed with the defendant who was previously required to register per PC 290.
