License Suspension and/or Criminal Court Sentencing or VC 23152 (a) VC 23152 (b) VC 23152 (e) VC 23152 (g) - First Offense with No Refusal to Take a Test

The suspension alternative programs set forth below apply specifically to a first offense DUI with no injury and no allegation of a refusal to take a chemical test (breath or blood).

  • VC 23152 (a)- Under the influence of alcohol
  • VC 23152 (b)- Having a .08 blood alcohol concentration or higher
  • VC 23152 (e)- Operating a taxi or "for hire" vehicle with a BAC of .04 or higher
  • VC 23152 (g)- Under the influence of the combination of drugs and alcohol

Court

12 months of suspension but with unrestricted driving if the following is acquired:

  • Proof of the appropriate 1st offender DUI program
  • Proof of the acquisition of an SR-22 from an insurance company
  • Paying $125.00 reisuance fee to DMV
  • Proof of the installation of an IID (ignition interlock device).

OR

6 months suspension (BAC of .19 or less) or 10 months suspension (BAC of .20 or more) but with unrestricted driving with the exception that an IID must always be in the vehicle driven if the following is acquired:

  • Proof of the appropriate 1st offender DUI program
  • Proof of the acquisition of an SR-22 from an insurance company
  • Paying $125.00 reisuance fee to DMV
  • Proof of the installation of an IID (ignition interlock device).

Sentencing: Will include a county jail sentence of 0-6months.

DMV

4 months of suspension but with restricted driving (to, from and during a person's work and driving to and from any activities required the DUI program) with the acquisition of the following:

  • Proof of the appropriate 1st offender DUI program
  • Proof of the acquisition of an SR-22 from an insurance company
  • Paying $125.00 reisuance fee to DMV
  • Proof of the installation of an IID (ignition interlock device).

OR

4 months suspension can be converted to a 30 day or 1-month suspension followed by a 5 month period of restricted driving to, from and during employment or to and from any activities connected to the DUI program:

  • Proof of the appropriate 1st offender DUI program
  • Proof of the acquisition of an SR-22 from an insurance company
  • Paying $125.00 reisuance fee to DMV

* These DMV suspensions are terminated upon a conviction in Criminal Court and the ordering of mandatory suspensions. A fine of $390-$1,000.00 (with additional cost enhancements, this amount generally rises to around $2,000.00 dollars); informal court probation of 3-5 years including terms requiring no measurable amount of alcohol when driving, no commission of any criminal offense and, if arrested, no refusal of a chemical test.
